Official Rules of the Scheyden Precision Eyewear Sweepstakes

Every two weeks, Scheyden Precision Eyewear ("Scheyden") will award one lucky eligible entrant one pair of Scheyden "flip-up" sunglasses of the winner's choice (available styles only, Dual Flip Rx excluded; up to $350 retail). The odds of winning depend on the number of entries received.

NO PURCHASE NECESSARY TO ENTER OR WIN. Product purchase will not enhance chances of winning a prize.

1. ELIGIBILITY
The Scheyden Precision Eyewear Sweepstakes (the "Sweepstakes" or "Promotion") is offered and open only to legal residents of United States and its territories at least 18 years old at the time of entry. Employees, shareholders, officers, directors and agents of West Coast Trends, Inc. "Sponsor"), their parent, affiliated and subsidiary companies, advertising and promotion agencies, and the immediate family or members of the households of such employees, shareholders, officers, directors and agents are not eligible to enter. By entering, you agree to these Official Rules and the decisions of Sponsor, which are final and binding in all respects. Duplicate email addresses are not permitted. Additional submissions of a previously registered email address will not be added to the Sweepstakes list. The Sweepstakes is subject to all applicable federal, state, and local law regulations and are void wherever prohibited by law. By participating you accept these Official Rules and to the decisions of the Sponsor, which are binding in all matters and all respects relating to the Sweepstakes.

2. PROMOTIONAL PERIOD
The Sweepstakes shall begin on Tuesday, July 1, 2008 12:00 a.m. pacific time and shall end on Tuesday, June 30, 2009 (the "Sweepstakes Period"). The sweepstakes shall consist of consecutive two-week Promotional Periods ("Promotional Period") commencing July 11, 2008. Sponsor reserves the right to terminate the promotion by giving notice at any time during any calendar month, deemed appropriate by Sponsor, in which case the Sweepstakes shall terminate after the end of the last Promotional Period of that calendar month.

3. ENTRY
You can enter the Sweepstakes online. Anytime during the Sweepstakes Period (as defined above), go to http://www.scheyden.com, complete the online entry form by entering true and correct information in all required fields, click to submit, and you will automatically be entered once in the Sweepstakes. Electronic entries will be deemed made by the authorized account holder of the e-mail address submitted at time of entry. The "authorized account holder" is deemed to be the natural person who is assigned to a particular e-mail address by the applicable Internet access provider, online service provider or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A potential winner may be requested to provide Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry and is an otherwise eligible United States resident.

Upon entry into the Sweepstakes, you will be automatically entered into each ensuing drawing and Sweepstakes until you win or until the end of the Sweepstakes, whichever is sooner. Limit one (1) entry per person, per e-mail address during the entire Sweepstakes Period.

Duplicate email addresses are not permitted. Additional submissions of a previously registered email address will not be added to the Sweepstakes list. Sponsor reserves the right to void entries that appear to come from Sweepstakes Clearinghouse Auto Entry websites.

Sponsor will use entered e-mail addresses to identify random winners (available characters: six (6) each of A-Z, 0-9, _ (underscore), & . (dot) – not case sensitive). A random drawing will occur within 3 days of the end of each Promotional Period. If your entry is randomly selected, then you will be awarded a pair of Scheyden Precision Eyewear Sunglasses, selected by you from among the available styles (up to $350 retail, Dual Rx Flip excluded), upon verification of eligibility. Winners will be notified by e-mail within approximately three days of the drawing. Upon notification, the winner must provide an e-mail response containing current shipping address and phone number within 48 hours of notification, and their name will be posted on the www.Scheyden.com website for winner notification and promotional purposes only. If notified winner does not respond within 48 hours of notification, then a new winner will be randomly selected.

Sponsor's decisions as to all matters related to administration of the Sweepstakes and selection of winners are final. Potential winner must comply with all terms and conditions set forth in these Official Rules, and winning is contingent upon fulfilling all requirements.

By registering with Scheyden.com you incur no obligations other than your agreement to be bound by these Official Rules, the Scheyden.com Terms of Service and Privacy Policy and to receive emails and or newsletters from Scheyden. By entering the Sweepstakes and/or registering with Scheyden.com, you expressly consent to receive e-mail messages and newsletters from Sponsor and/or Scheyden. You may opt-out of the receipt of such emails by following the directions in any email you receive. Submission of an email to (anyname)@scheyden.com requesting removal from our email list will permanently remove that email address from our sweepstakes list, unless otherwise instructed in writing.

Receipt of the bi-monthly Scheyden newsletter indicates your registration in the sweepstakes.

No assignment, transfer or substitution of prize is permitted. All prize values are expressed in U.S. Dollars. Prizes not won or claimed by the end of the Sweepstakes will not be awarded. Prizes won by minors are null and void, and any participant who is not 18 years of age or older will be automatically disqualified. Winners are solely responsible for any and all taxes that may be due to State, local or foreign taxing authorities. Winners must provide any requested information/data necessary to satisfy taxing authorities' prior to award offer.

4. USE OF DATA
Sponsor will be collecting personal data about participants (including, without limitation, e-mail addresses) when they enter the Sweepstakes online. By participating in the Sweepstakes online, entrants hereby agree to all personal information uses and disclaimers as explained in Sponsor's Privacy Policy http://www.scheyden.com/privacy.html.

5. GENERAL CONDITIONS
Where permitted by law, winners grant to Sponsor, and those acting pursuant to its direction or control, (and agree to confirm such grant in writing upon request), the right to print, publish, broadcast and use, worldwide in any media now known or hereafter developed, including but not limited to the world wide web, at any time or times, the winner's name, portrait, picture, voice, likeness and biographical information as news or information and for advertising, trade and promotional purposes without additional consideration and without notification, review or approval.

Participants release and agree to hold harmless Sponsor, and its parent, affiliates, subsidiaries, advertising and promotion agencies and each of their respective directors, officers, employees, representatives and agents from any and all liability for any injuries, loss or damage of any kind to person, including death, and property, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any prizes or giveaways awarded in this Sweepstakes, participation in this Sweepstakes, or participation in any Sweepstakes related activity.

Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering with the entry process or the operation of the Sweepstakes or web site; to be in violation of the Terms of Service of the web site; to be acting in violation of the Official Rules; to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.

If for any reason this Sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which, in the sole opinion of Sponsor, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Sponsor reserves the right to cancel, terminate, modify or suspend the Sweepstakes for any reason at any time. If the Sweepstakes is terminated prior to its expiration date, notice will be posted at http://www.scheyden.com.

All entrants consent to the exclusive jurisdiction of the Superior Court for the County of Orange, State of California, United States of America for resolution of any and all relating to this Sweepstakes. This Sweepstakes shall be governed by the laws of the State of California. Sponsor reserves the right to modify or supplement these rules at any time.

6. LIMITATIONS OF LIABILITY
Sponsor is not responsible for late, lost, illegible, misdirected, incorrect or erroneous entries, and Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to its web sites. Sponsor is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any web site, or any combination thereof. Sponsor is not responsible for any incorrect or inaccurate capture of information or the failure to capture such information, whether caused by web site users, tampering or hacking, or by any of the equipment or programming associated with or utilized in the Sweepstakes. Sponsor is not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of the web site.

IN NO EVENT WILL SPONSOR, OR ITS PARENT, AFFILIATE, SUBSIDIARY AND RELATED COMPANIES, THEIR ADVERTISING OR PROMOTION AGENCIES OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF INTERNET SITE WWW.SCHEYDEN.COM OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SAID SITE. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THIS SITE AND IN THIS PROMOTION IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. 7. DISPUTES, FORUM SELECTION, CHOICE OF APPLICABLE LAW
As a condition of participating in this Sweepstakes, and by registering with Scheyden.com, PARTICIPANT AGREES THAT THE EXCLUSIVE FORUM FOR RESOLUTION OF ANY AND ALL DISPUTES WHICH CANNOT BE AMICABLY RESOLVED BETWEEN THE PARTIES, AND ANY AND ALL CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS SWEEPSTAKES, OR ANY PRIZES AWARDED, OR THE DETERMINATION OF WINNERS SHALL BE THE SUPERIOR COURT OF CALIFORNIA, COUNTY OF ORANGE. Further, by participating in the Sweepstakes and by registering with Scheyden.com, participant hereby expressly agrees that under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including without limitation, attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., costs associated with entering this Sweepstakes), and participant further waives all rights to have damages multiplied or increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and Sponsor in connection with this Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of California, U.S.A., without giving effect to the conflict of laws rules thereof. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry, as defined above.
